· The Kratom Informational Hearing was a critical inflection point for the California Legislature to better understand the safety profile of natural kratom leaf and extract products that truly are helping people to manage their health and well-being, and the importance of access by consumers to these safely formulated products.

· Importantly, it exposed the imminent threat posed by chemically manipulated 7-OH products and the dangerous product formulations the significantly increase the danger to consumers by an industry committed to mislead consumers that their products are just kratom.

· Finally, the dogmatic and tone-deaf California Department of Public Health continued to justify their efforts to interfere with consumer access to safety formulated, appropriately labeled, and age restricted natural kratom leaf and extract products based solely on their extreme interpretation of the application of federal and state law on kratom products.

 

The American Kratom Association (AKA) will continue its efforts to encourage the California Legislature to protect access to safe kratom products for consumers and require the Department of Public Health to adhere to the regulatory requirements of the Kratom Consumer Protection Act.

On Feb. 3rd, 2026, Los Angeles Board of Supervisors approved Motion SD4, "Preventing Deaths Related to Kratom and 7-Hyroxymitragynine" directing County healthy officials to study both 7-hydroxymitragynine (7-OH) and kratom products in an effort to recommend next steps on regulation.

This review process represents a critical opportunity to ensure LA County adopts a science-based, targeted regulatory framework that protects public health while preserving safe, responsible, adult access to natural kratom leaf products.

We have to prevent Los Angeles County from passing overly broad restrictions or a blanket prohibition.

Stop Seizures, Government Overreach and Calling Safe Kratom Illegal

Recently the California Department of Public Health has declared “It is unlawful in California to sell Kratom as a food, dietary supplement, or drug to those of any age” in California. Read recent release from CDPH

This is a massive overreach of power and creates immense confusion and problems for California kratom consumers. Message the California State Legislature today and share your story why CA DPH needs to follow the law and let the legislature appropriately regulate safe kratom products. The FDA has distinguished between natural kratom and synthetic products, so why isn’t the California DPH?
